DMCA Policy for Praline Pecans
Praline Pecans respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) of 1998, the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, Praline Pecans will respond promptly to claims of copyright infringement committed using the Praline Pecans website or online services (the "Site") that are reported to Praline Pecans's Designated Copyright Agent, identified below.
If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement and delivering it to Praline Pecans's Designated Copyright Agent.
Filing a DMCA Notice of Alleged Infringement
Upon receipt of a valid notice, Praline Pecans will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged content from the Site. For your DMCA Notice to be valid, you must provide the following information:
- Identify the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by this Notice, you may provide a representative list of the copyrighted works that you claim have been infringed.
- Identify the material that you claim is infringing (or to be the subject of infringing activity) and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Praline Pecans to locate the material (e.g., URL of the specific page where the material is located).
- Provide your contact information, including your full legal name, mailing address, telephone number, and email address.
- Include a statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Include a statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Provide your physical or electronic signature (e.g., by typing your full legal name).
Filing a DMCA Counter-Notification
If you believe that your content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the content, you may send a counter-notice containing the following information to our Copyright Agent:
- Identify the specific URLs or other unique identifying information of the material that Praline Pecans has removed or to which Praline Pecans has disabled access.
- Provide your contact information, including your full legal name, mailing address, telephone number, and email address.
- Include a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Praline Pecans may be found.
- Include a statement that you will accept service of process from the person who provided the original notification of the alleged infringement.
- Include a statement that, under penalty of perjury, you have a good faith belief that the material was removed or disabled as a result of mistake or a misidentification of the material to be removed or disabled.
- Provide your physical or electronic signature (e.g., by typing your full legal name).
Please note that Praline Pecans will provide the original copyright complainant with a copy of your counter-notification, including your contact information, and that the complainant may initiate legal action against you.
